NY Court Awards Employee Over $1 Million for Sexual Harassment, Wrongful Termination, and Retaliation
New York, NY – The Derek Smith Law Group is pleased to announce that on September 29, 2021, Zachary Holzberg, Esq. of the Derek Smith Law Group obtained a 1.3 Million Dollar judgment for his client in a sexual harassment case. This case is a testament to the outstanding advocacy skills of Mr. Holzberg as well as sending a message to sexual harassers that their conduct will not be tolerated.
The allegations in the case are as follows.
According to the complaint, our client was hired as an English tutor and then a personal assistant to a wealthy entrepreneur residing in New York City. Our client alleged that his boss (the defendant) would come on to him, touch his penis in an alleged act of sexual assault, and make our client feel uncomfortable with sexual gestures and unwanted physical contact both in public and private. Our client began to suffer from anxiety and alopecia due to the stress of these actions.
Once the defendant became aware of our client’s rejection of his alleged sexual advances, he purportedly terminated our client’s employment.
Mr. Holzberg filed a claim against the defendant alleging a hostile work environment due to sex and gender discrimination, sexual orientation discrimination, sexual harassment, retaliation, and wrongful termination. The courts determined our client was damaged in the amount of $1.3 million.
