Not every employment case involves a firing or harassment. Some of the most common problems are simply about money you were never paid in the first place.
Wage and hour violations can show up as:
The amounts here add up quickly, sometimes into the thousands over a year or two. An Echo Park employment attorney can go through your pay records, work out what you’re actually owed, and pursue it, often with added penalties. Employers rely on workers not doing that math themselves. That’s precisely where having a lawyer changes the outcome.
“Employment law” sounds narrow, but it covers a lot more ground than most people expect. Many workers are dealing with more than one of these issues at once, which is why it helps to know the different types of cases our team handles:
If any of this sounds like your situation, it’s worth talking it through. A lot of people assume what happened to them was “just how work is,” when it’s actually a violation the law takes seriously.
Echo Park’s economy runs on small restaurants and bars, music venues, coffee shops, creative studios, and independent retail, and that shapes the kind of employment disputes we see here.
Small teams often mean no real HR department, so policies get made up as needed and pay practices can be inconsistent from one employee to the next. It’s common for the owner or manager to be the same person responsible for creating the problem, which makes “just talk to HR” a non-answer.
That doesn’t put you at a disadvantage. Informal workplaces tend to leave a different, sometimes more revealing kind of paper trail: texts, group chats, and coworkers who saw the same treatment firsthand. An employment lawyer serving Echo Park who understands how these small businesses actually run knows exactly where to look.
If you think something illegal happened, a few early moves can protect your case:
That last point trips people up constantly. Employers often hand over documents that quietly sign away your rights. The Derek Smith Law Group can review anything you’ve been given and tell you plainly what it actually means before you agree to it.
Where your claim goes depends on what kind of problem you’re dealing with. Discrimination and harassment claims typically start with a filing through the California Civil Rights Department, formerly known as the Department of Fair Employment and Housing. Claims involving Echo Park workers may proceed through Los Angeles Superior Court if litigation becomes necessary. Wage claims, on the other hand, may go through the California Labor Commissioner’s office, or directly to court.
For many discrimination and harassment claims, you generally have three years to file the administrative complaint, and one year from any “right-to-sue” notice to bring a lawsuit, with litigation often proceeding through Los Angeles Superior Court. An Echo Park employment lawyer can tell you exactly which deadlines apply so a valid claim doesn’t expire.
When an employer breaks the law, you may be owed real compensation, not just an admission that something went wrong. Depending on your case, that can include:
Every case is different, and no honest attorney can promise a specific number before reviewing the details. What we can promise is a clear, straight answer about what your claim may realistically be worth.
If something at work crossed a line, you don’t have to sort out the next step by yourself. What feels overwhelming right now is often more common, and more fixable, than it seems.
The Derek Smith Law Group has spent decades taking on employers who assumed no one would push back. We’ll review your situation for free, explain your options in plain English, and if we take your case, you won’t owe us a dime unless we win.
